1. Acceptance of Terms

By accessing or using the Petrosoft TankGenie platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users, including company administrators, operators, and viewers. If you do not agree with any part of these Terms, you must not use the Service.

The Service is provided by Petrosoft Technologies, a technology company specializing in petroleum industry solutions.

2. Description of Service

Petrosoft TankGenie is a professional tank calibration management platform that enables petroleum industry professionals to generate accurate calibration tables, manage tank data, produce calibration certificates, and access AI-powered insights. The Service is provided on a subscription basis to registered companies and their authorized users.

3. User Accounts

• You must be invited by a company administrator to access the platform. Self-registration is not permitted without an invitation.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to notify us immediately of any unauthorized use of your account.
• Accounts are non-transferable and may not be shared with other individuals.
• You must provide accurate and up-to-date information when setting up your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must NOT:

• Use the Service to store or transmit unlawful, harmful, or fraudulent content
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Reverse-engineer, decompile, or disassemble any part of the platform
• Use automated tools or scripts to scrape, crawl, or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Share or resell access to the Service without prior written consent from Petrosoft
• Submit false, misleading, or fabricated calibration data

5. Data Ownership & Responsibility

You retain ownership of all data you input into the platform, including tank specifications, calibration measurements, and company information. By submitting data, you grant Petrosoft a limited license to process and store such data solely to provide the Service. You are solely responsible for the accuracy of the data you submit and any decisions made based on generated calibration outputs.

6. Intellectual Property

The Petrosoft TankGenie platform, including its software, algorithms, design, trademarks, and documentation, is the exclusive property of Petrosoft Technologies. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited right to use the Service as described herein. All AI models, calibration algorithms, and generated outputs remain the property of Petrosoft.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. While Petrosoft strives for accuracy in calibration calculations, we do not warrant that the results are free of errors or suitable for any specific regulatory or legal compliance purpose. Users are responsible for verifying calibration outputs against applicable industry standards and regulations before operational use.

8. Limitation of Liability

To the fullest extent permitted by law, Petrosoft Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total cumulative liability shall not exceed the amount paid by you for the Service in the three (3) months preceding the claim.

9. Termination

Petrosoft reserves the right to suspend or terminate your account at any time if you breach these Terms or engage in conduct that is harmful to the platform or other users. Upon termination, your right to access the Service ceases immediately. You may also request account closure at any time by contacting us at info@petrosoft.com.ng.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nigeria.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.
